1. Services and Use

2. Term & Billing
- Services are provided on a month-to-month basis unless agreed otherwise in writing.
- Monthly fees begin from the order date and are billed in advance.
- Upgrade or additional services ordered mid-cycle are pro-rated.
- One-time fees (e.g., setup, late fees) are due immediately.
3. Payments & Non-Payment
- All payments must be made by the monthly billing anniversary date.
- A 10% late fee applies if payment is missed.
- Services will be suspended after 5 days of non-payment; terminated after 7 days.
- A $50 reconnect fee applies after suspension.
- Chargebacks are strictly prohibited and may incur a $200 penalty.
4. Cancellations & Refunds
- A 14-day written notice before the next billing date is required to cancel or downgrade services.
- No refunds are provided for services, including setup or administrative fees.
- Customer data will be retained for 30 days post-cancellation and then deleted permanently.
5. Service Level Agreement (SLA)
- We operate on a best-effort basis for uptime and issue resolution.
- Uptime may exceed 99%; however, no guarantee is made unless specified in a separate agreement.
- Downtime due to scheduled maintenance, third-party issues, or user error is excluded from SLA credit.
6. Privacy Policy
We collect and use data as outlined in our Privacy Policy which includes:
- Information via forms, cookies, IP addresses, communications, and transactions.
- Data used to process transactions, improve services, respond to inquiries, and manage communications.
- Sensitive information is protected using standard security measures.
- We notify users in case of data breaches as required by law.
7. Acceptable Use Policy
Users must not engage in activities that include, but are not limited to:
- Copyright infringement, SPAM, phishing, malware distribution.
- Hosting illegal, hateful, or terrorist content.
- Using services for harassment, threats, or fraudulent activity.
- Violating any applicable laws.
Violations will follow a resolution path ranging from notification to suspension or termination of services.
8. Data Responsibility
While we use best practices to secure and backup customer data, ultimate responsibility for data integrity, security, and backups remains with the customer.
9. Intellectual Property
- You may not use our name, logo, or branding without written permission.
- We will not use your brand or data without your consent.
10. Limitation of Liability
We are not liable for indirect, special, or consequential damages. Our total liability is limited to the amount paid by you in the six months prior to any claim.
11. Arbitration
Disputes over $500 shall be resolved by binding arbitration in accordance with commercial arbitration rules.
12. Electronic Signature
By using our website and services, you consent to this agreement electronically. Your continued use indicates acceptance of these terms.
13. Changes to Terms
We may update these Terms at any time. Continued use of our Website or services after changes are posted constitutes acceptance of those changes.
